As the World Recovers, Regulatory & Enforcement Environment

This session will highlight the most significant regulatory and enforcement changes that have been implemented by Federal authorities throughout the pandemic. Several regulatory changes were implemented for a short duration, such as the invocation of 1135 waiver authority, whereas other changes will likely have a lasting effect on the way in which providers assess regulatory risk and implement strategies aimed at reducing them. Regardless of the government’s intended duration of the pandemic-related changes, most of the remedy and enforcement changes will have long-lasting effects on skilled nursing providers.

This session is intended to emphasize the most significant regulatory changes and the consequences of those changes, which are oftentimes not readily apparent until after it is applied to a set of facts.

Following this session, attendees will be better equipped to identify regulatory risk areas based on current government initiatives and, in turn, proactively implement processes aimed at reducing the pandemic-related damage skilled nursing providers will likely continue to sustain into the future.   

Learning Objectives
  1. Identify significant changes to regulatory participation requirements that have been implemented since January 2020.
  2. Describe the modified regulatory enforcement remedies and the impact that different deficiencies, and scope/severity levels of those deficiencies can have on the outcome of a survey/enforcement cycle.
  3. Identify the way in which procedural timelines for maintaining and/or attaining substantial compliance with skilled nursing provider participation requirements have changed throughout the pandemic.
